Terms of Service

These Terms of Service ("Terms") govern your access to and use of SmartCV (the "Service") at smartcv.lk, operated by SmartCV ("we", "us" or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 16 years old and able to enter into a binding agreement to use the Service. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.

2. The Service

SmartCV lets you enter your details and create, edit, preview, share and download professional CVs. Building and downloading CVs is free. Optional AI features - such as writing summaries, improving bullet points, generating cover letters, reviewing a CV, suggesting skills, tailoring to a job description, and importing an existing CV - consume paid credits (see section 5). The Service is provided on an "as is" and "as available" basis.

3. Your account

  • You are responsible for keeping your login credentials secure and for all activity under your account.
  • You agree to provide accurate account information and to keep it up to date.
  • Notify us promptly of any unauthorised use of your account.

4. Your content

You retain ownership of the content you put into your CVs ("Your Content"). You grant us a limited licence to store, process and display Your Content solely to provide the Service to you - including sending relevant content to our AI provider when you use an AI feature. You are responsible for Your Content and confirm that you have the right to use it, that it is accurate, and that it does not infringe anyone else's rights. When you import a CV, you confirm you have the right to upload that file.

5. Credits and payments

  • AI features consume credits. Credits can be purchased in packs through our payment processor, Stripe. New accounts receive a small number of free credits to try the AI features.
  • Each AI generation uses one or more credits, and the cost is shown before you run it. If a generation fails, the credit(s) reserved for it are returned to your balance.
  • Because credits deliver a digital service immediately, purchased credits are non-refundable except where required by law or where we choose to grant a refund at our discretion (for example, for a billing error).
  • Prices and pack contents may change from time to time. Any change applies only to purchases made after the change.
  • You are responsible for any taxes that may apply to your purchase other than taxes on our income.

6. AI features and accuracy

AI-generated text, reviews, scores and extracted data are suggestions and may be inaccurate, incomplete or unsuitable for your situation. You are responsible for reviewing and editing anything the AI produces before you rely on or submit your CV. We do not guarantee any particular outcome, including employment or interview results.

7. Sharing

You may enable a public link to share a CV. When you do, anyone with the link can view that CV. You are responsible for choosing to share a CV and for who you share the link with. You can disable a share link at any time.

8. Acceptable use

You agree not to:

  • use the Service for any unlawful, fraudulent or harmful purpose;
  • enter or upload another person's data without their permission;
  • upload malware or content that infringes others' rights;
  • attempt to break, probe or circumvent the Service's security or access controls;
  • scrape, resell, or abuse the Service, or attempt to bypass credit limits or payment;
  • interfere with other users' use of the Service.

9. Intellectual property

The Service, including its software, design, branding and the SmartCV name and logo, belongs to us and is protected by law. These Terms do not grant you any right to our intellectual property except the limited right to use the Service as intended.

10. Third-party services

The Service relies on third parties (including our hosting, database, AI, email and payment providers). Your use of those parts of the Service may also be subject to those providers' terms, and we are not responsible for their acts or omissions.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted or error-free operation.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss, or for loss of data, opportunities or profits, arising from your use of the Service - including any inaccuracy in a generated or imported CV. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the three months before the claim, or LKR 6,000.

13. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users. Unused credits have no cash value and are not refundable on termination except as required by law.

14. Changes to these Terms

We may update these Terms from time to time. The "last updated" date above shows when they last changed. If we make material changes, we will take reasonable steps to notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of Sri Lanka, and the courts of Sri Lanka will have jurisdiction over any dispute, without regard to conflict of laws principles.
